Terms of Service Agreement

You MUST read and agree with all terms before proceeding.

We provide for our users hosting for personal or commercial use.  These terms and conditions are subject to change without notice by posting of new terms and conditions to this page as deemed necessary by management of Nethost.ws.  Any change in terms and conditions become effective immediately at time of publishing.

Any account found spamming will have their account suspended or terminated without notice.

No Autoresponders or Bulk Email Scripts Are Allowed On Any Site Hosted By Nethost. 

No "Safemail" or Bulk Incoming Mail Is Allowed On Any Site(s) Hosted By Nethost.

Any Account Found In Violation Of This Policy Will Be Terminated Immediately And Without Notice.

The files uploaded by the user:

  • shall not contain nudity of any kind.
  • shall not be obscene, contain child pornography.
  • shall not violate any local, state, or federal laws concerning decency.
  • shall not be fraudulent or involve the sale of counterfeit or stolen items.
  • shall not contain any viruses, trojan horses, worms, time bombs, cancelbots or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data, or personal information.
  • shall not infringe any third party's copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy.
  • shall not violate any law, statute, ordinance or regulation (including without limitation those governing export control, consumer protection, unfair competition, anti-discrimination, false advertising, deceptive practices, or securities transactions).
  • shall not be defamatory, libelous, unlawfully threatening or unlawfully harassing.
  • shall not create liability for us or cause us to lose (in whole or in part) the services of our ISPs or other suppliers.
  • shall not use our system to distribute non-image data, such as executables or MP3 music files.

It is left to each individual user when uploading images, or using images we host on external websites, to abide by any applicable local, state, or federal laws, statues, ordinances and regulations that may apply. Images reported or found to be in violation will be promptly removed, without notice from us, and the user may be subject to account termination, without possibility of refund for any unused account balances, nor recourse by the customer.

We will cooperate with fully, and provide any useful information available, to any legal or governmental agency in the event of investigation into any legal or questionable violations by a customer.

Unlimited Bandwidth Qualifications

Customers must pay additional bandwidth fees for database server or RealMedia server transfers that exceed 10 GB, in the aggregate, during any calendar month.

To protect the legitimate Internet use of our Customers, Customers may not:  

  • Resell or give away Web space under a domain name or create "sub domain" Web sites on behalf of other companies, groups or individuals. Customers interested in reselling the Company's Web hosting services should utilize the Company's Reseller Program.
  • Use the Web site to store Web pages, files or data for other IP addresses or domain names, or as a repository for files, data or "Warez group" download transfer.
  • Offer adult content, mp3 downloads, or software downloads.
  • Use the Web site as a storage area for files that are not linked to Customer's Web pages hosted on the same site on Interland's servers.
  • Utilize CGI/PERL chat, JAVA chat or any other chat scripts.
  • Nethost may immediately suspend service without notice to any Web site that violates these rules in manner or  adversely affects the operations or performance of other Nethost customers.

In the event of any dispute regarding these rules, Nethost may determine violations of these rules in its sole discretion. Customers utilizing bandwidth in excess of plan limitations, or in violation of these rules, will pay Nethost the applicable rate for excess bandwidth.

Free accounts are limited to two. Anyone found to have multiple accounts are subject to removal without notice.   Free accounts are limited to 10 Megabytes of disk space and 1000 Megabytes bandwidth/transfer per month.  Free accounts may upgrade to a paid hosting package by filling in the form found at http://www.nethost.ws/upgrades.htm and clicking the submit button.

Free accounts are subject to termination if inactive for a period of 30 days or more.  "Inactive" is defined as no transfer or bandwidth being utilized by that account. 

Nethost.ws reserves the right to terminate any or all free accounts with or without notice;  however it is our policy to give notice to the account holders via the email address on file.  It is the responsibility of the free account holder to maintain and update their "contact" email address.  In the event that the free account holder does not receive any notice, it is agreed that Nethost.ws is not and will not be held liable or responsible in any way for unretrievable content, lost business and is to be held harmless for any consequential damages that are the result of any free account terminated for any reason.

All pornography and sexually explicit images are strictly prohibited! Any accounts containing these types of images will be deleted immediately without notice!

No user will use specialized electronic devices, scripts, batch files, or other devices to use the site in any non-typical manner. This includes automated account signups.

Login information is not to be shared. Accounts found to be in use by multiple hosts or individuals will be subject to immediate termination without prior notification. User passwords and login credentials are to be protected by the account owner. We will not be responsible for unauthorized account access in the event a password is protected by the user. If you suspect a person has accessed your account without authorization, it is your responsibility to change your password and contact us immediately.

Users found to be otherwise abusing the system will be subject to account termination at our discretion. Abuse will be defined as generated traffic equivalent to 1/4 of the user's average monthly transfer exceeded within a 24 hour period, or data transfer exceeding that of 10 times the average user's data transfer levels. As these values will vary, Nethost.ws retains the right to adjust our definition of "abuse" as conditions change.

There will be no refunds after 30 days of receipt of payment. Refunds requested within 30 days of receipt of payment will be given at our discretion, and will be subject to processing and transaction fees.

Refunds of any portion of unused subscription payments after an account termination on the part of the customer will be at our discretion.

Although we strive for 100% service availability, we offer no warrants or guarantees as to the performance, availability or speed of its image hosting service, nor offers any warrants as to suitability or fitness for any particular use.
